Consignment Terms & Conditions

These Terms & Conditions govern all consignment services provided by SPEARING EVENTS PTE. LTD. (UEN: 200906709H), having its principal place of business at 12 Woodlands Square, Woods Square Tower 1, #11-85, Singapore 737715, and including its affiliated entities, subsidiaries, and associated businesses, whether incorporated locally or overseas (collectively referred to as the “Company”).

By creating a consignment account, electronically accepting these Terms, or submitting item(s) for consignment, the Consignee agrees to be bound by these Terms.

The Consignee and the Company shall collectively be referred to as the “Parties” and individually as a “Party”.


Definitions

“Company” means SPEARING EVENTS PTE. LTD. (UEN: 200906709H), including its affiliated entities, subsidiaries and associated businesses, whether incorporated locally or overseas.

“Consignee” means the customer consigning item(s).

“Item(s)” means all collectible items accepted for consignment, including but not limited to trading cards, graded slabs, raw cards, coins, memorabilia and other collectible products approved by the Company.

“Portal” means www.spearingtracker.com and related digital services.

1. Consignee Responsibilities

1.1 Item Information, Pricing and Labelling

Consignees are responsible for providing accurate pricing, labelling and item details, including but not limited to category, brand, set, item number, variations, editions, grading details and any other relevant information required for listing.

Consignees are advised to provide their own pricing labels. The Company shall not be responsible for errors or discrepancies in pricing or item information where such information was provided by the Consignee.

All pricing labels should clearly display the assigned Consignment Number.

1.2 Item Condition and Records

Consignees must inspect each item before handover and are responsible for maintaining records, including photographs, of the item condition prior to submission.

The Company will verify item(s) during intake. Any claim relating to item condition, damage or missing item(s) must be supported by the Consignee’s records.

The Company’s intake records shall be used as the official reference in the event of any dispute.

1.3 Ownership, Authenticity and Legality

The Consignee warrants that all submitted item(s) are authentic, legally owned or authorised for consignment, and may lawfully be sold.

If any item(s) are subsequently determined or reasonably suspected by the Company to be counterfeit, altered, unauthorised, stolen, or otherwise not suitable or permitted for sale, the Company reserves the right to reject, remove, suspend listing, or return such item(s) to the Consignee.

The Company shall not be responsible for any losses, claims, fees, costs, or damages arising from the submission of such item(s) by the Consignee.

The Consignee shall remain responsible for ensuring that all submitted item(s) comply with applicable authenticity, ownership and legal requirements.

Where applicable, the Company may request supporting documentation or proof of ownership before accepting or continuing to list such item(s).

1.4 Account Registration

Consignees are encouraged to create an account on www.spearingtracker.com to conveniently view active consignments, item listings, sales records, payout records and consignment history.

2. Item Listing and Limits

2.1 Monthly Consignment Limit

Each Consignee may consign a maximum of forty (40) item(s) per calendar month.

This limit is implemented due to the Company’s existing public liability insurance coverage, insurance considerations, storage capacity and operational requirements.

The Company may review or adjust this limit where required based on operational or insurance requirements.

2.2 Submitted Item(s)

Once submitted, item(s) cannot be swapped or replaced.

Item(s) may only be removed following a written request by the Consignee and written acknowledgement by the Company.

Removed item(s) cannot be re-added if the monthly consignment limit has already been reached.

2.3 Binder Requirement

Where applicable for card-related item(s), Consignees should provide one (1) standard 9-pocket, 360-card binder for listing purposes.

Duplicate item(s) are permitted but must be entered separately.

2.4 Alternative Listing Arrangements

If a Consignee is unable to provide a suitable 9-pocket binder, alternative listing arrangements may be discussed with the Company on a case-by-case basis.

The Company reserves the right to determine the most suitable listing method based on operational requirements.

2.5 Insurance Coverage

The Company maintains public liability insurance and other relevant coverage for its operations, subject to insurer terms, exclusions, limitations and coverage conditions.

The Company shall not be responsible beyond the applicable coverage and terms of its insurance policies.

The Company may suspend or limit consignments where insurance, storage capacity or operational requirements require.

2.6 Rental Binder

Subject to availability, the Company may provide a rental binder for S$10.

Rental binders remain Company property and may only be used during the active consignment period.

The Company reserves the right to revise the rental binder fee from time to time based on changes in supplier costs, replacement costs, operational expenses or other related factors. Any revised fees will be communicated to the Consignee prior to the rental arrangement.

3. Sales and Payouts

3.1 Sale Recording and Final Sale Determination

When an item is sold, the sale will be recorded by Company staff.

The final recorded sale amount, applicable commission, deductions and payout amount shall be determined by the Company based on the transaction records and applicable terms.

The Company’s recorded transaction details and payout calculation shall be considered final and shall not be subject to dispute once confirmed.

3.2 Payment Methods

Payouts will generally be processed via PayNow on the same day.

Where PayNow cannot be completed, cash payouts may be approved on a case-by-case basis.

3.3 Payment Details

Consignees are responsible for providing accurate payment details, including registered PayNow name and number.

3.4 Sale Confirmation

After payment is completed, an acknowledgement message confirming the sold item(s) will generally be sent by the end of the same business day.

3.5 Commission

The minimum listing price is S$2.00.

A minimum commission of S$1.00 per item applies.

Standard commission is generally 10–15% per item.

3.6 No Guarantee of Sale

The Company does not guarantee any sale, selling price or timeframe.

The Company shall not be responsible where an item does not sell due to pricing, market demand or other external factors.


4. Listing Exclusivity and Changes

4.1 Listing Exclusivity

Item(s) consigned with the Company must not be listed for sale through other platforms or channels during the active consignment period.

4.2 Requests for Changes

Requests to remove item(s), amend pricing or make changes must be submitted through WhatsApp at +65 6513 5900.

Requests will only take effect after written acknowledgement by the Company.

All requests must be submitted during Company operating hours. The Company will generally respond within 2–3 business days.

The Company shall not be responsible for sales completed before changes are processed and confirmed.

For urgent matters, Consignees may contact the Company directly through the same number during operating hours.


5. Digital Services and Records

5.1 Electronic Acceptance

By creating an account, electronically signing, selecting “I Agree” or submitting item(s) through the Portal, the Consignee agrees that such electronic actions have the same effect as a handwritten signature.

5.2 Digital Records

The Company maintains digital records including:

  • Consignment history
  • Item listing records
  • Sales records
  • Payout records
  • Timestamps
  • Edits and amendments
  • Removal requests
  • Staff processing records

These records are retained within the system for up to three (3) months and shall constitute the Company’s official records.

5.3 Account Security

The Consignee is responsible for maintaining the security of their account credentials.

5.4 Communications

Communications through SpearingTracker, WhatsApp and email shall constitute valid written communications.

5.5 System Availability

The Company shall not be liable for temporary interruptions, maintenance, technical issues or system downtime affecting the Portal.

6. Liability

6.1 Indemnification

The Consignee agrees to indemnify and hold the Company harmless from claims, losses, damages, liabilities, costs and legal expenses arising from the consignment of item(s), except where caused by the Company’s wilful misconduct or gross negligence.

6.2 Item Condition Records

The Consignee is responsible for recording and photographing the original condition of submitted item(s).

The Company is not responsible where original condition records have not been maintained and is under no obligation to verify conditions beyond its intake process.

6.3 Limitations of Liability

While reasonable care will be taken, the Company shall not be liable for:

  • Ordinary wear and tear
  • Pre-existing defects
  • Market fluctuations
  • Events beyond the Company’s reasonable control

6.4 Incident Review and Compensation

In the event of any incident involving a Consignee’s item(s) while under the Company’s custody, the Company will review the circumstances fairly and determine any applicable responsibility or compensation based on available records, insurance coverage, investigation findings and relevant circumstances.

Any compensation, where applicable, shall be limited to the extent of liability determined and/or covered under applicable insurance terms.

The Company’s determination shall be final.

7. General

7.1 Collection of Item(s)

Withdrawn or unsold item(s) should be collected within 30 days unless otherwise agreed.

7.2 Severability

If any provision is found unenforceable, the remaining provisions shall remain effective.

7.3 Waiver

Failure by the Company to enforce any provision shall not constitute a waiver.

7.4 Entire Agreement

These Terms constitute the entire agreement unless otherwise agreed in writing.

7.5 Amendments

The Company reserves the right to amend these Terms by publishing an updated version.

7.6 Governing Law

These Terms are governed by the laws of the Republic of Singapore and disputes shall be subject to the exclusive jurisdiction of the Singapore courts.
